Cottage Food Laws

This food is made in a home kitchen and is not inspected by the Department of State Health Services or a local health department. 

Due to Texas Cottage Law we are prohibited from making foods that require temperature control. Examples: Pudding, Cheesecake, Tres leches cake, Etc.

Prepayment /Payment Due

You pay, we bake! Payment is required up front in order to start prepping your delicious, sweet creations!! Your payment reserves your pick-up date as well.  Baby Bake Cake reserves the right to cancel invoices not paid 24 hours after they are sent out. Please reach out if you have questions or concerns about payment. 

Weddings & Quinceaneras

Deposit: There is a $100 deposit paid to reserve your date (unless 50% is paid upon booking). In the event of cancellation, your deposit is NON-REFUNDABLE 

Down Payment: In addition to the deposit, a 50% down payment is required 2 months prior to the event date. If signing within 2 months of event date, 50% is due upon signing.

Final Payment: The remining balance is due 3 weeks prior to your event date. Orders will not be fulfilled if final payment has not been received. All payments are NON-REFUNDABLE

No show = No Baked Goods

To stay on schedule and to insure other customers get their orders too, a pick up time will be set in place at the time of ordering. Not showing up to the agreed upon pick up time without notice will result in a late fee of $35 and/or a rescheduled pick up time. 

Need to reschedule your pick-up? No problem! Please reach out in a timely manner prior to your pickup time and we will try to work something out so you can still enjoy your fresh Baby Bake Goodies !!! 

Refunds/Cancellations  

We only offer refunds up to 48 hours after payment has been accepted, if your order is not in preparation status. Therefore, refunds are not eligible for rushed orders. If there is a problem with your order, please reach out so we can do our best to make things right.

Delivery Clause

We offer delivery upon request for an additional fee (fee amount depends on location). In some cases long distance delivery may be an option.

Cakes and Delivery

Since cakes are delicate pieces of art and a lot can go wrong if not handled with the most care. Delivery is mandatory for cakes that are over one tier. This insures proper transportation and less room for a cakecident!

Pick-up Dates and Times

Delivery and pick up times are set at time of order placement. This is necessary as other customers are waiting to receive their baked goods too!! 

Change Order Cutoff

Decisions are tough! But we are here to help. Reach out and let us know if you need to make small changes and we will do our best to accommodate. A small fee may apply to all change order requests under consideration. 

Inspiration

We appreciate those inspiration pictures! They are just that – inspiring. But your cakes/cupcakes may not be perfect replicas – we try to keep it as close as possible.

In a hurry?

While we cannot accommodate all last minute orders, we will make every effort. Orders placed with a turnaround time of less than a week (7 days), will require a rush order fee. Fee amount varies by order. Please ask! 

Price Adjustments

In the current market, all prices are subject to change. Prices are dictated by ingredient and packaging costs. We try to provide the best tasting sweets to our customers at the best value. This also means that we cannot honor old pricing for prior items. 

Product Photography

We often take photos of our orders for marketing purposes. If you do not want your sweets in the spotlight, please let us know at the time of order placement. 

Copyrights

Copyright images (think Star Wars and Peppa Pig) are protected images and Baby Bake Cake is unable to replicate them. We can make a similar color palette though so please reach out to discuss options.

Pictures are Worth a Thousand Words

But they are not always accurate. Colors and lights in photos may vary slightly from what you end up with.

It’s All Yours Now

Once you pick up your order we are no longer responsible for any damages that may occur. Please handle with care.

No Ghosts

To get your order just right, we need you to reply to our messages and questions within a reasonable (1 hour) timeframe; otherwise, we reserve the right to use our own creative liberty.

Baby Bake Cake Art and Right of Refusal

All productions are due to the creativity and talent of the owner and artist of Baby Bake Cake. As such, we reserve the right of refusal of any order that is deemed outside the scope of that art. 

Allergies?

Baked goods are often made with foods that can be known allergens. Please order with caution. We can’t always accommodate allergy conscious orders. Please do reach out, as we may have a perfect referral for you! 

In Sickness and Health

You are consuming food and with the consumption of anything, there are inherent risks. Choking hazards, injury, food illnesses, and allergic reactions are possibilities. Baby Bake Cake is not reasonable for any of these that may occur.

Weather Clause

If pickup is impossible due to inclement weather please reach out to discuss options.

Bulk Orders

We are unable to offer discounts regardless of quantity. If you have a specific budget you are working with, feel free to let us know in advance and we will do our best to offer you a solution that fits your budget. 

Agreement

Once you have submitted payment for your order, this constitutes acceptance of these Terms and Conditions.
